Alabama Fireworks Laws & Regulations

Consumer Fireworks Regulations


Specifically Permitted

Class C consumer fireworks per the United States Department of Transportation, including, but not limited to, aerial devices, audible ground devices, sparkling devices, and novelties and those items that comply with the construction, chemical composition, and labeling regulations promulgated by the United States Consumer Product Safety Commission and permitted for use by the general public under their regulations.

Specifically Prohibited

Manufacture, possession, sale or use of “illegal ground salutes,” fireworks containing more than 2 grains of explosive composition; any mail-order fireworks.

Selling Period

June 20-July 10 and December 15-January 2. Sales from tents or motor vehicles are prohibited.

Age of Purchase

16 years, unless accompanied by adult.

Licensing

The State Fire Marshal shall charge for permits issued as follows:

(1) Manufacturer, three thousand dollars ($3,000).

(2) Distributor, three thousand dollars ($3,000.00).

(3) Wholesaler, one thousand dollars ($1,000.00).

(4) Retailer, three hundred dollars ($300.00) and varies by type of fireworks sold.

(5) Seasonal Retailer, three hundred dollars ($300.00) and varies by type of fireworks sold.

(6) Seasonal Retailer after July 10, one hundred fifty dollars ($150.00) and varies by type of fireworks sold.

(7) Display, seventy five dollars ($75.00). (8) Display, one hundred fifty dollars ($150.00) if filed less than 10 business days before display date.

NOTE: Additional permit fees required for manufacturing.

All fireworks that are not defined as salable consumer fireworks.

Selling Period

The sale or use of fireworks may be suspended in any area where the Dept. of Natural Resources has declared the wild fire danger to be high/extreme or depleted of resources.

Annual wholesale and retail licenses required. Apply to the State Fire Marshal.

Wholesale license $50

Arkansas Fireworks Laws & Regulations

Specifically Permitted

Permit required for: Roman candles, skyrockets, helicopter rockets, cylindrical and cone fountains, wheels, torches, colored fire, dipped sticks, mines, and shells, firecrackers with soft casings, and novelties (size limitations specified.) No permit required for: toy pistols, toy canes, toy guns, or other devices in which paper caps containing twenty-five-hundredths grains (0.25 gr.) or less of explosive compounds are used, provided they are so constructed that the hand cannot come in contact with the cap when in place for exploding, and toy paper pistol caps which contain less than twenty-five-hundredths grains (0.25 gr.) of explosive compounds, cone, bottle, tube, or other type serpentine pop-off novelties, nonpoisonous toy snake, smoke sticks without report, and sparklers, the sale and use of which shall be permitted at all times.

Specifically Prohibited

M-80s, M-100s, quarter sticks, cherry bombs, and silver salutes as they are federally illegal.

Selling Period

June 20-July 10 and December 10-January 5 (Snakes and sparklers permitted all year.)

Ground and handheld sparkling devices, cylindrical fountains, cone fountains, illuminating torches, wheels, ground spinners, flitter sparklers, toy smoke devices, wire sparklers or dipped sticks, multiple tube ground and handheld sparkling devices, cylindrical sparkling devices.

Specifically Prohibited

Anything designed or intended to rise into the air and explode or to detonate in the air or to fly above the ground, including firework items defined by the APA 87-1 and known as firecrackers, bottle rockets, sky rockets, missile-type rockets, helicopters, aerial spinners, torpedoes, roman candles, mine devices, shell devices and aerial shell kits or reloadable tubes

Selling Period

Year-round except certain jurisdictions may further restrict “sales” outside of the following dates: April 25 – May 6, May 20 – July 6 and December 10 — January 3 and may further restrict “use” outside of the following dates: May 4 through May 6, June 24 through July 6 and December 24 through January 3 of each year.

Age of Purchase

18 years of age or older.

Fireworks for sale must be tested and appear on the approved list issued annually by the State Fire Marshall’s office. Permitted all year: Snap Caps and Bang Snaps

Specifically Prohibited

Sky rockets, bottle rocket, roman candles, aerial shells, firecrackers, other fireworks that explode, go into the air, or move on the ground in a uncontrollable manner and all other devices not appearing on SFM annual approved list.

Selling Period

12 noon on June 28 through 12 noon on July 6. Local authorities have the right to further restrict “sales” and “use.”

Wood stick and wire sparklers with no more than 100 grams of pyrotechnic composition; other hand-held or ground-based sparkling devices which are non-explosive and non-aerial, which may produce a crackling or whistling effect, and which contain 75 grams or less of pyrotechnic composition per tube or a total of 500 grams or less for multiple tubes; snakes, glow worms and smoke devices which contain 20 grams or less of pyrotechnic composition; trick noisemakers, which include party poppers, snappers and drop pops, each containing 16
mg or less of pyrotechnic composition.

Specifically Prohibited

All consumer fireworks not specifically permitted including firecrackers, torpedoes, sky rockets, Roman candles, daygo bombs and aerial shell devices.

Selling Period

Sales are permitted: 30-days prior to July 4 and 30-days prior to December 31.
Use is permitted: June 4th – July 4th and December 1st – January 1st

Age of Purchase

18 years of age or older.

Devices approved and listed by State Fire Marshal which emit a shower of sparks upon burning, do not contain any explosive compounds, do not detonate or explode, are handheld or ground based, cannot propel themselves through the air, and contain no more than 100 grams of the chemical compound that produces sparks upon burning. Any device that is
not included in the list of approved items is prohibited, except that snakes, smoke devices, trick noisemakers, party poppers, booby traps, snappers, trick match. cigarette load, and auto burglar alarms, each of which are subject to size limitations and may be sold at all times.

Specifically Prohibited

Firecrackers, torpedoes, skyrockets, roman candles, daygo bombs, and any fireworks containing explosive or flammable compounds.

Selling Period

Seasonal Retailers: June 20 – July 5 and December 10- January 2. Certain fireworks are permitted to be “used” on the following designated holidays:

(a) New Year’s Day, January 1;
(b) Independence Day, July 4; or
(c) New Year’s Eve, December 31.

All consumer fireworks meeting CPSC criteria as defined in 16 C.F.R. Parts 1500 and 1507, 49 CFR Part 172, and the APA 87-1 (2001 ed.); Roman Candles; wire or wood sparklers of 100 grams or less of mixture per item; other sparkling items which are nonexplosive and nonaerial and contain 75 grams or less of chemical compound per tube or a total of 500 grams or less for multiple tubes; snake and glow worms; smoke devices; or trick noise makers which include paper streamers, party poppers, string poppers, snappers, and drop props each consisting of 0.25 grains or less of explosive mixture.

Specifically Prohibited

“[B]alloon, bag, parachute, or other similar device which requires fire underneath for propulsion or to release or cause to be released any floating water lantern or wish lantern which uses a flame to create a lighting effect in any public waterway, lake, pond, stream, or river.”

Selling Period

All year. Check with local authorities having jurisdiction for further restrictions on “use.”

Age of Purchase

18 years or older.

Licensing

Initial license fee for a distributor selling consumer fireworks from a permanent consumer fireworks retail sales facility shall be $1,500.00 per location. provided, however, that the initial license fee shall be $5,000.00 for a distributor that was not licensed prior to July 1, 2016. After initial license, distributor may annually renew the license for $1,000.00 per year, payable to the Safety Fire Commissioner.

Items that comply with regulations of CPSC and DOT definitions. Permit required for each 5,000 individual units of firecrackers.

Specifically Prohibited

Aerial fireworks such as, bottle rockets, sky rockets, missile-type rockets, helicopters, torpedoes, daygo bombs, roman candles, flying pigs, and jumping jacks, which move about the ground farther than inside a circle with a radius of twelve feet as measured from the point where the item was placed and ignited, aerial shells and mines.

Selling Period

5 Days prior to use. Dec 26 to midnight Dec 31 and June 29 to July 4.
Permitted use:
From 9:00 p.m. on New Year’s Eve to 1:00 a.m. on New Year’s Day; From 7:00 a.m. to 7:00 p.m. on Chinese New Year’s Day; and From 1:00 p.m. to 9:00 p.m. on the Fourth of July; or) From 9:00 a.m. to 9:00 p.m. as allowed by permit pursuant to section 132D-10 if the proposed cultural use is to occur at any time other than during the permissible periods. Check with each local authority having jurisdiction for any further restrictions

Other licenses issued by the State Fire Marshal: Importer License application and fee ($1,000) must be submitted by January 31st of year to be licensed.

Wholesaler license application fee of ($2,000) must be submitted by January 31st of year to be licensed.
